These Terms of Use ("Terms") govern your use of The Crowd, a mobile game published by Fat Moai ("we", "us"). By creating an account or playing, you agree to them. If you do not agree, please do not use the app.
You must be at least 18 years old, or the age of majority where you live if that is higher. You need a valid mobile phone number, which we use to verify your account. One account per person. Accounts may not be shared, sold, or transferred.
You choose a username when you sign up. It is visible to other players, the host, and anyone watching a show, so please choose something you are happy to be seen. We may reclaim or change usernames that impersonate others, infringe a trademark, or breach the conduct rules below.
You are responsible for activity on your account. Tell us promptly if you believe someone else has access to it.
The Crowd is a game of skill. We survey a group of people with a question, and your goal is to guess the answers they gave most often. Points are awarded according to how many survey respondents gave the same answer.
Live shows run to a published schedule. In each round you submit up to three answers before the timer expires. Answers that do not appear on the board cost you a shield; when your shields are gone, you are out of that show. A revive, where you hold one, returns you to play once per show.
The Daily Buzzer pairs you against another player over three timed rounds. Points are claimed by whoever submits a matching answer first.
We match answers using an automated system that allows for common spellings, plurals, and synonyms. That system is not perfect and its decisions are final.
Some shows award cash prizes. Entry is free and no purchase is ever required to enter, win, or claim a prize. Prizes, eligibility, and how winners are determined are set out in the Official Rules, which form part of these Terms.
The app may offer optional paid items, such as the Beta Pass. Purchases are processed by Apple or Google, and their refund policies apply. Paid items are a limited, personal, non-transferable licence to use digital content inside the app. They have no cash value, cannot be exchanged for money, and do not increase your chance of winning a prize.
We may change, suspend, or withdraw any paid item. If we permanently retire an item you have bought, we will make a reasonable effort to offer an equivalent or a refund.

Shows have live chat. Keep it civil. Do not post content that is hateful, harassing, sexual, threatening, deceptive, unlawful, or that shares another person's private information. Do not advertise or spam. We moderate chat and may remove messages or revoke chat access at any time.
You keep ownership of what you write, but you grant us a non-exclusive, worldwide, royalty-free licence to display it in the app and in recordings or clips of a show.
Shows are broadcast live and may be recorded, clipped, and shared on our own channels. Your username, avatar, score, chat messages, and placement may appear in that material.
If you allow push notifications, we use them to tell you when a show is about to start and when something happens in your account. You can turn them off at any time in the app's settings or in your device settings.
We do our best to run shows as scheduled, but we cannot promise the service will always be available or uninterrupted. Shows may be delayed, shortened, or cancelled. If a show is cancelled part-way through, we will decide in good faith whether to award prizes, and how.
You may stop using the app at any time and ask us to delete your account. We may suspend or close an account that breaches these Terms, or where we are required to by law. Unclaimed prizes are forfeited if an account is closed for a breach.
The app is provided as-is. To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Where our liability cannot be excluded, it is limited to the greater of the amount you have paid us in the previous twelve months, or fifty US dollars.
We may update these Terms. If a change is material we will tell you in the app before it takes effect. Continuing to play after that means you accept the updated Terms.
